General Terms and Conditions
These are the General Terms and Conditions of the Delight Group, of which Delight Academy is part. For the specific rules and regulations of Delight Academy of Ayurveda, please consult our Student Statute and the Exam Regulations.
1. Definitions
1. Additional Terms and Conditions: the additional general terms and conditions applicable to the Workshops, Retreats and Teacher Trainings organized by Delight Yoga.
2. Application form: The application form of Delight Yoga that has to be filled out and signed by the aspiring participant prior to the Workshop, Retreat or (Pre) Teacher Training of Delight Yoga.
3. Ayurveda Practitioner Studies: the 4-year HBO conform Ayurveda study, which trains its participants as an Ayurveda Practitioner.
4. General Terms and Conditions: The general terms and conditions used by Delight Yoga, which have been published at the Delight Yoga website.
5. Delight Yoga: Delight Yoga BV has its official seat at Prinseneiland 20 G, 1013LR Amsterdam and is listed in the Trade Register under number 24718106.
6. Delight Card: a 10-class card or a 20-class card, as referred to in Clause 4.
7. Introduction to Yoga Program: a 2-hour introduction session and 5 beginner yoga classes, as referred to in Clause 3.6.
8. Deposit/application fee: the deposit/application fee, as mentioned on the Application form that has to be filled out and signed by the aspiring Participant prior to the Retreat or (Pre) Teacher Training of Delight Yoga, which has to be paid by the Participant at least 4 weeks prior to said training or retreat.
9. Financial Agreement: the agreement between Delight Yoga and the aspiring Participant of the yoga teacher (Pre-) Teacher part of the Application Form, in which the forms of payment for this training are set forth.
10. Membership: the membership for attending yoga classes at Delight Yoga, issued or to be issued by Delight Yoga and paid or to be paid by the Student.
11. Single Class: a single yoga class at Delight Yoga to be attended and paid by the Student, other than on the basis of any Membership.
12. Participant: the person who attends or wishes to attend a Retreat, (Pre-) Teacher Training or Workshop.
13. Pre-Teacher Training: the 50-hour preparatory training offered by Delight Yoga prior to the training that trains its participants to become a yoga teacher.
14. Price: the total price of a Workshop, (Pre-) Teacher Training or Retreat, including the Deposit/application fee.
15. Private Class: a private yoga class at Delight Yoga, for which the Student must make an appointment in advance.
16. Private Card: a card for 5 or 10 private classes.
17. Retreat: a yoga retreat organized by Delight Yoga
18. Teacher: the yoga teacher who has been contracted by Delight Yoga to teach yoga classes during the yoga teacher (pre) training of Delight Yoga.
19. Teacher Training: the Delight Yoga Advanced Studies 350+ hours, or any modules of this program including the Basic Teacher Training, which trains its participants in their further development as yoga teachers.
20. Student: a person who attends and/or wishes to attend private or group yoga classes, trainings, retreats or workshops at Delight Yoga.
21. Website: the website of Delight Yoga: www.delightyoga.com
22. Workshop: A yoga- or yoga-related workshop given or to be given by Delight Yoga.
23. Academy Workshop: Workshop which is part of the Academy of Ayurvedic Studies.
2. Scope of Application
1. The General Terms and Conditions apply to any membership and, where applicable, to all Delight Cards, the Private Card and Single and Private Classes of and at Delight Yoga as well as to all Retreats, (Pre-) Teacher Trainings and Workshops.
2. By participating in a Retreat, Workshop, (pre) Teacher Training or yoga class of Delight Yoga, the Student agrees to the applicability of these General Terms and Conditions.
3. Delight Yoga may from time to time amend these General Terms and Conditions. The most recent version of the Terms and Conditions is always the version that is applicable and is always available at the Website. Delight Yoga will announce any amendments to the General Terms and Conditions in advance by email.
3. Monthly Membership (with Mysore access), Yearly Membership (with Mysore access), Delight Cards, Private Card 60 and 90, Online Membership and Online Cards.
Delight Yoga offers the following possibilities of attending yoga classes at Delight Yoga:
**1. MONTHLY MEMBERSHIP (with Astanga Mysore) and YEARLY MEMBERSHIP (with Astanga Mysore)**
1. The Monthly and Yearly Membership entitles the member to an unlimited number of yoga classes during the term of the Membership.
2. The minimum Membership term for the Monthly Membership is one (1) month. After the first month, a Student’s Monthly Membership is tacitly converted into a continuing agreement for an indefinite period. The minimum Membership term for the Yearly Membership is twelve (12) consecutive calendar months. After the twelve months, a Student’s Membership will be tacitly converted into a Monthly Membership for an indefinite period.
3. The Membership commences either on the agreed starting date or on the day the first payment is made by IDEAL, Paypal or Credit Card. The next monthly cycles will be paid by direct debit, until termination.
4. After the minimum term of one (1) month, a Student’s Monthly Membership may be terminated every month. Membership must be cancelled prior to the individual renewal date in order to end membership charges. Cancellation of Monthly Membership must be processed by the Student through their My Delight account. Delight Yoga will not reimburse the Student for the remainder of any paid subscription period, nor will reimbursements be made for membership cancellations prior to any renewal date.
5. A Student’s Monthly Membership may be put on hold for one (1), two (2) or three (3) months. This may be done by updating the membership settings in the Student’s My Delight account up until 1 day prior to the start of the new months Membership. The Yearly Membership may also be put on hold for one (1), two (2) or three (3) months during the 12-month period. This month of suspension does not count for the 12-month period; if the membership is put on hold for one (1) month the end date of the contract will be extended with one (1) month.
6. A Student may use any Membership only in the event of payment by direct debit (monthly Membership only).
7. The Membership fee will be debited from the Student’s bank account around the starting day of the current Membership month. If this starts on the 1st of the Month (e.g. 1 March), the Membership Fee will be debited around the 1st of this month (e.g. around 1 March). If the membership starts on a different date of the Month (e.g. 17 March), the Membership fee will be debited around that same date (e.g. around 17 March). In case Delight Yoga is unable to collect the Membership Fee on the first collection moment, Delight Yoga will send the student a notification by email informing the student that the collection of the monthly membership payment has failed. There will be a second collection moment around the 10th or 25th day of the month (whichever is the closest date to receiving a notification). In case Delight Yoga remains unable to collect the Membership fee with the second collection moment, an administration fee of €25 will be charged without prior notice. If the payment has not been made through no fault of the Student, no administration fee will be charged.
8.All Dutch Bank accounts and bank accounts from European SEPA countries are supported for the direct debit payment (monthly Membership only). 9. A Student’s Membership commences when Delight Yoga has received the membership fee from the Student.

**2. DELIGHT GUEST CLASS**
1. The Delight Guest Class entitles the Student to one (1) yoga class.
2. The Delight Guest Class is valid for two (2) months from the date of purchase. The 1 class must therefore be attended within two (2) months of the date of purchase. After that period this right lapses.

**DELIGHT INTRODUCTION CARD**
1. The Delight Introduction Card entitles the Student to five (5) yoga classes and can be purchased only once by new Students. A new Student may use the Delight Introduction Card only if he or she has not attended more than one (1) yoga classes at Delight Yoga.
2. The Delight Introduction Card is valid for one (1) month from the date of purchase. The 5 (five) classes must therefore be attended within one (1) month of the date of purchase. After that period this right lapses.

**4. DELIGHT CARD 10-CLASSES / DELIGHT CARD 20-CLASSES**
1. The Delight Card entitles the Student to ten (10) or tweny (20) yoga classes.
2. The Delight Card – 10 classes is valid for three (3) months after the date of purchase. The 10 classes must therefore be attended within three months of the date of purchase. After that period, this right lapses. The Delight Card – 20 classes is valid for 6 months after the date of purchase. The 20 classes must therefore be attended within 6 months of the date of purchase. After that period, this right lapses.

**5. PRIVATE CARD 60 and 90 **
1. The “Private Card 60” and the “Private Card 90” entitle the Student to five or ten private yoga classes of 60 and 90 minutes, respectively.
2. The “Private Card 60” and the “Private Card 90” are valid for six months from the date of purchase. This means that the five or ten classes must be attended within six months of the date of purchase.

**6. INTRODUCTION TO YOGA PROGRAM**
1. The “Introduction to Yoga Program” entitles the Student to one 2-hour introduction Workshop and five yoga classes.
2. The “Introduction to Yoga Program Workshop” is valid for six months from the date of purchase. The introduction workshop must therefore be attended within six months of the date of purchase. After that period this right lapses. The “Introduction to Yoga Program five yoga classes” are valid for one month after the date of the attended “Introduction to Yoga Program Workshop”. After that period this right lapses.

**7. ONLINE MEMBERSHIP WEEKLY / ONLINE MEMBERSHIP MONTHLY**
1. The “Online Membership” entitles the Student to an unlimited number of online yoga classes during the term of the Membership.
2. Online Classes can be viewed upto a minimum of one month prior to when they have been broadcasted. Except for Zoom Classes, Zoom classes will not be recorded because of privacy reasons.
3. The minimum Membership term for the Monthly Online Membership is one (1) month. After the first week, a Student’s Online Membership is tacitly converted into a continuing agreement for an indefinite period.
4. After the minimum term of one (1) month, a Student’s Monthly Online Membership may be terminated every month. A Membership must be cancelled prior to the renewal date in order to end membership charges. Cancellation of Online Membership must be processed by the Student through their My Delight account. Delight Yoga will not reimburse the member for the remainder of any paid subscription period, nor will reimbursements be made for membership cancellations prior to any renewal date.
5. The Online Membership commences on the day the first payment is made by IDEAL, Paypal or Credit Card. The next weekly cycles will be paid by direct debit, until termination.
6. The Student can not freeze the Delight Online membership, unless Delight is not able to deliver the online service to support it.
7. All Dutch Bank accounts and bank accounts from European SEPA countries are supported for the direct debit payment (monthly Membership only). **8. ONLINE CARD 1 CLASS / ONLINE CARD 5 CLASSES**
1. The Delight Online Card entitles the Student to one (1) or five (5) online yoga classes
2. Online Classes can be viewed up to at least one month after they have been live-streamed. Except for Zoom Classes, Zoom classes will not be recorded because of privacy reasons.
3. The Delight Online Card 1 or the Delight Online Card 5 classes is valid for one (1) month from the date of purchase. The 1 or 5 classes must therefore be attended within one (1) month of the date of purchase. After that period this right lapses
4. Payment and Price Changes
1. All yoga classes organized by Delight Yoga must be paid for before they are held. Delight Yoga does not accept cash payments. Payments can be made by direct debit (memberships only), PIN, Credit Card (Visa, Master Card), Ideal and PayPal.
2. As a general rule, direct debits for memberships are made monthly around the 1st day of the membership. If the amount cannot be collected, a handling fee of €25 is charged. In the case of non-payment, Delight Yoga reserves the right to suspend the account of the relevant Student after 1 month of overdue payment.
3. Delight Yoga reserves the right to change the pricing of all Delight products. Any changes are announced in advance by putting up posters on the premises of Delight Yoga, by placing statements on the Website, and/or by email. The currently applicable rates are always mentioned on the Website and are available for inspection at the reception desk of Delight Yoga.
4. On presentation of an official Student card, Delight Yoga grants a 10% discount on all private and group yoga classes at Delight Yoga, except for the Introduction Card and the Membership.
5. Reservations and cancellations for yoga classes
1. All classes are available for online booking 7 days in advance.
2. A Student can only book classes and smaller workshops online.
3. A confirmed booking is valid until 5 minutes before the class starts. If the Student has not checked in by then, the booking expires and the reserved spot will become available to another Student
4. When a class is fully booked, the Student can sign up for the Waiting List. If a spot opens up, the first Student to book the class through the schedule will be notified by email .
5. Students can cancel their booking until six (6) hours before the class starts. The Student can only cancel through the personal My Delight Account, so not by phone or email.
6. If the Student cancels within six hours before the beginning of the class, this will be noted as a “Late Cancel”. Upto three (3) Late Cancels are allowed. If the limit of three Late Cancels is exceeded Delight will reserve herself the right to suspend the possibility to book online for one month for this particular Student. In that case the Student can still make use of one of the 3 walk-in spots in case they are available.
7. If you have a (Introduction or Delight) Card and you don’t show up to this class or don’t cancel it up until 6 hours in advance, this class will be charged from your card.
8. Cancelling an appointment for a private class, massage or healing can be done without charge up to 24 hours before the start of the appointment. The Student will be charged in full if the private appointment is canceled within 24 hours before the start of the appointment.
6. Schedule
1. The current schedule is mentioned on the Website. Delight Yoga reserves the right to change the schedule at any time. If possible, any changes are announced in advance by putting up posters in the Delight Yoga rooms, mentioning them on the Website or by email.
2. Delight Yoga reserves the right to cancel a yoga class that has been scheduled or to change the yoga teacher mentioned in the schedule in the event of force majeure, including illness of the teacher. In the case of replacement of a teacher there will be no refund of any Membership fee.
3. Delight Yoga reserves the right to close its doors on public holidays or on other days, or when imposed by the government, in case of force majeure, national safety or a pandemic.
7. Early Termination of Membership in case of illness
1. In the event of prolonged illness or an injury, the Student may terminate the Membership early. A request for early termination must be submitted to Delight Yoga in writing and Delight Yoga reserves the right to evaluate and handle each case individually. This termination may be sent by email to [email protected]
8. Liability
1. Attending yoga classes, Workshops, Retreats and leaving belongings in the changing rooms are at the Student’s own risk. Delight Yoga accepts no liability for loss or damage of personal belongings of a Student attending yoga classes, workshops, trainings or retreats and leaving belongings in the changing rooms at Delight Yoga. If during a retreat or workshop the student causes loss or damage to property of the venue where the student is staying, the student will be held liable. This loss or damage is in no way covered by Delight Yoga. The student is considered to have the right insurance to cover this loss or damage.
2. Delight Yoga is not in any way liable for personal injuries sustained during yoga classes, workshops, trainings or retreats. Participating is always at the own risk of the Student.
3. Delight Yoga provides the following guidelines for reducing the risk of an injury:
4. Always consult a doctor before starting yoga classes if you are not sure that you are completely healthy or if you are pregnant.
5. If you have an injury or any other physical inconvenience, always inform your yoga teacher about this before starting the yoga class.
6. Listen to and follow the instructions of the relevant yoga teacher.
7. Perform the yoga exercises carefully and bear your physical limitations in mind.
8. Do not perform any yoga exercises that are painful.
9. Ask questions if you do not understand an exercise.
10. Avoid inverted poses during menstruation.
11. Although we strive to only provide correct information on our website, we are not liable for any inaccuracy and no rights can be derived therefrom.
9. Personal Data
1. Delight Yoga collects personal data of the Students and Participants to update its membership records, to execute payment orders and for administration and information purposes. Delight Yoga handles this collection of personal data with due care and complies with the provisions of the Dutch Data Protection Act.
2. Delight Yoga uses the personal data referred to in Clause 9.1 to inform the Students and Participants about activities of Delight Yoga and any changes in the schedule, for example. If the Student or Participant does not want to receive communications from Delight Yoga, he or she may unsubscribe from the mailing in the bottom of a received newsletter or communicate this to Delight Yoga by sending an email to [email protected] The Student or Participant is aware (s)he cannot use all online services and products of Delight Yoga in that case.
3. Delight Yoga never gives any personal data of the Students or Participants to third parties without their prior written consent.
10. Governing Law and Dispute Settlement
1. The General Terms and Conditions are exclusively governed by Dutch law.
2. Any disputes relating to the General Terms and Conditions, any Membership, a Delight Introduction Card, a Delight Card, a Private Card or a Student’s attending group and private yoga classes, Workshops or Retreats organized by Delight Yoga are settled exclusively by the competent court in Amsterdam or any higher court.
11. Code of Conduct
1. Students shall adhere to Delight Yoga’s code of conduct at all times:
2. Please make sure you are clean and fresh when you attend the yoga class. The use of unscented deodorant is highly appreciated. In view of potential allergies of other Students, everyone is asked not to wear any perfume, aromatherapy oils or other scented products, and not to use any spray deodorant in the changing rooms.
3. Wear clean yoga clothes in yoga classes, in which you can move easily.
4. Delight Yoga advises not to eat later than two hours before the start of the yoga class and, in any case, not to do yoga on a full stomach.
5. Please do not wear shoes in the yoga studios.
6. Due to extra safety measures regarding the Covid-19 virus, we ask you to bring your own yoga mat and props when possible, and to bring covers to cover our props during yoga classes, courses and workshops. Props may be used only when covered with a clean pillow case, scarf or towel. Delight Yoga makes yoga mats available for use during yoga classes and workshops only when the Student brought a yoga mat towel to cover the mat. After classes, a yoga mat must always be cleaned thoroughly and put back by the Student who has used it.
7. To allow everybody to find perfect inner peace, Students are requested not to talk in the yoga studio before, during and after the yoga class and to talk quietly in the other rooms.
8. The physical and mental integrity of Students must always be respected. Sexual behaviour or sexually suggestive behaviour is not tolerated by Delight Yoga.
9. Delight Yoga reserves the right to deny Students who do not observe the house rules referred
10. to in Clause 11.1, to deny access to the Delight Yoga premises and to terminate the Membership of the relevant Student without a refund of any membership fee paid already.
**ADDITIONAL GENERAL TERMS AND CONDITIONS FOR WORKSHOPS, (PRE-)TEACHER TRAININGS AND RETREATS OF DELIGHT YOGA**
12. Applicability of Additional Terms and Conditions and Definitions
1. Retreats, Teacher Trainings and Workshops are governed by these Additional Terms and Conditions in addition to the General Terms and Conditions. The General Terms and Conditions form an integral part of these Additional General Terms and Conditions. By participating in a Workshop, (Pre-) Teacher Training or Retreat, the relevant Participant accepts the applicability of the General Terms and Conditions and the Additional General Terms and Conditions.
2. Delight reserves the right to replace the teachers of Workshops, Retreats and Pre-Teacher Trainings in case of illness or injury of the original teacher without further consequences. Delight will guarantee that replacement of a teacher will not affect the contents and quality of the training.Replacement of a teacher will therefore not be accepted as a valid reason for cancellation.
13. Participation in Workshops and/or Retreats and Registration Fee
1. A Participant may participate in a Workshop or Retreat after he or she has registered for it with Delight Yoga in advance and paid the Price. Registration may be affected by signing up through the website or by sending an email to [email protected] A spot in the Workshop or Retreat is guaranteed after Delight Yoga has received payment of the Price or the Deposit/application fee.
2. For some Workshops and Retreats, an “Early Bird Rate” applies. This reduced rate applies until the date specified on the Website. After this date the normal rate, which is also specified on the Website, applies without exception.
3. All participants are responsible for having the correct insurance (travel and/or liability) needed to participate in the workshop or retreat.
14. Participation in (Pre-) Teacher Trainings
1. Participants may only participate in the Pre-Teacher Training or the Teacher Training, as the case may be, after they have filled out the Application Form completely, made the Deposit/application fee payment through the Website and subsequently have received an invitation from Delight Yoga to participate in the Pre Teacher Training or the Teacher Training, as the case may be.
15. Payments and Prices
1. The Price for a Workshop, Retreat or (Pre-) Teacher Training can be found on the Delight Yoga website.
2. Payments for a Workshop or Retreat must be made before the Workshop or Retreat is held. Payments can be made by direct debit, IDEAL, PIN, PayPal or Credit Card (Master or Visa Card) or with credit on your Delight account as the case may be.
3. In the event of participation in a Retreat, the Deposit/application fee must be paid 60 days before the scheduled Retreat at the latest. The balance must be paid 30 days before the Retreat scheduled at the latest.
4. Deposits are non-refundable when:
5. The Student cancels on his/her own initiative for reasons other than named at 15.5
6. The Student cancels due to of postponement or changed start date/time of a Training, Workshop or Retreat by Delight
7. The Student decides to cancel because of changes in the Training, Workshop or Retreat due to force majeure.
8. The workshop is cancelled or postponed by Delight for reasons due to force majeure.
9. Deposits will be converted into Delight Credits if a Student cancels their participation in the Training, Workshop or Retreat due to personal force majeure like injury, physical illness, family emergencies, etc.
10. If Delight cancels a Training, Workshop or Retreat for reasons other than force majeure, the deposit and other payments will be refunded in full
11. The Price for a (Pre) Teacher Training and possible payment plans are mentioned on the Application Form under Financial Agreement.
12. To complete the application for a (Pre) Teacher Training, a deposit/application fee payment must be made through the Delight Yoga website via iDEAL, Credit Card or PayPal.
13. The balance for the (Pre) Teacher Training needs to be paid no later than 4 weeks prior to the training start date. The Participant will receive an email from Delight Yoga agreeing on the ways of paying the Price, including a possible payment plan.
16. Cancellation of Workshop Registration
1. Any participation in a scheduled Workshop may be cancelled only in writing. Cancellations can be done by sending an e-mail to: [email protected]
2. In the cancellation policy we make a distinction between small workshops (0-250 euro) and large workshops (250 – 5000 euro).
3. Small Workshop registrations can be cancelled free of charge until one (1) month before the scheduled Workshop date.
4. If the Participant cancels his or her registration for a small Workshop between one (1) month and two (2) weeks before the scheduled Workshop date, a handling fee of €25 will be charged.
5. Large Workshop registrations can be cancelled free of charge until two (2) months before the scheduled Workshop date.
6. If the Participant cancels his or her registration for a large Workshop between two (2) months and two (2) weeks before the scheduled Workshop date, the deposit will not be refunded. If there was no deposit paid for this particular workshop we will charge a handling fee of 50 euro.
7. If the Participant cancels his or her registration for any workshop (large or small) later than two (2) weeks before the scheduled Workshop date, the registration fee is not refunded.
8. In case of force majeure like a pandemic, natural disaster, terrorist attack, etc., Delight withholds the right to postpone, to cancel or to make adjustments to the Workshop without further liabilities.
17. Cancellation of Participation in Retreat
1. Any participation in a scheduled Retreat may be cancelled only in writing. This can be done by sending an email to [email protected]
2. The Retreat Participant may cancel his or her registration free of charge until four (4) months before the scheduled Retreat.
3. If the Participant cancels his or her Retreat between four (4) months to two (2) months before the scheduled Retreat, the deposit will not be refunded.
4. In between two (2) months and one (1) month before the scheduled Retreat, the Retreat Participant may cancel his or her registration, in which case 50% of the Price is charged.
5. If the Retreat Participant cancels his or her registration within one (1) month before the start of the Retreat, the Price will be charged to the participant as the case may be.
6. If it turns out at the location of the Retreat that the Retreat Participant cannot participate in the Retreat for whatever reason, the Price already paid will not be refunded.
7. Delight Yoga reserves the right to cancel the Retreat if there are insufficient participants. In this case, the registration fee already paid by the Participants is refunded as soon as possible.
8. In case of force majeure like a pandemic, natural disaster, terrorist attack, etc., Delight withholds the right to make adjustments to the Retreat, to postpone or to cancel the Retreat without further liabilities.
18. Cancellation of Participation in (Pre-) Teacher Training
1. Any participation in a scheduled (Pre-) Teacher Training or any of its connected modules may be cancelled only in writing. This can be done by sending an e-mail to: [email protected]
2. The Participant shall make the Deposit/application fee payment for the (Pre-) Teacher Training as mentioned on the Application Form. Subject to article 1.2, the Deposit/application fee payment made by the Participant will become non-refundable after a cooling off period of 14 days.
3. The Participant may cancel his/her registration for the (Pre-) Teacher Training with full refund of the amount paid (minus the Deposit/application fee), until two (2) months prior to the start date of the training. This can be done by sending an e-mail to: [email protected]
4. In the case the Participant cancels their registration for the (Pre-) Teacher Training within two (2) months prior to its commencement, the Price will not be refunded, or the Price will be charged to the Participant, as the case may be.
5. Delight Yoga reserves the right to cancel the (Pre-) Teacher Training if there are insufficient participants. In this case, the Price already paid by the Participants is refunded as soon as possible.

9. Cancellation of Ayurveda Practitioner Studies (“APS”)
1. Any participation in the Ayurveda Practitioner Studies may be cancelled only in writing. This can be done by sending an e-mail to: [email protected]
2. The Participant shall make the Deposit payment for the Ayurveda Practitioner Studies as mentioned on the Application Form. Subject to article 1.2, the Deposit payment made by the Participant will become non-refundable after a cooling off period of 14 days.
3. The Participant may cancel his/her registration for the Ayurveda Practitioner Studies with full refund of the amount paid (minus the Deposit), until two (2) months prior to the start date of the Studies. This can be done by sending an e-mail to: [email protected]
4. In the case the Participant cancels their registration for the Ayurveda Practitioner Studies within two (2) months prior to its commencement, the Price will not be refunded, or the Price will be charged to the Participant, as the case may be.
5. Delight Yoga reserves the right to cancel the Ayurveda Practitioner Studies if there are insufficient participants. In this case, the Price already paid by the Participants is refunded within two weeks.
6. The tuition fees are non-refundable, and installments to be paid remain due.
7. In case of unforeseen circumstances like a pandemic, natural disaster, terrorist attack, etc., Delight withholds the right to postponement or cancellation of the Ayurveda Practitioner Studies. This clausule becomes effective when the government imposes measures or when it is within reasonable estimation to adjust, postpone or cancel the Ayurveda Practitioner Studies. In this case Delight is not liable for the refund of any deposit made prior to cancellation or postponement of the Ayurveda Practitioner Studies.
20. Workshop and (Pre) Teacher Training Schedule
1. The current Workshop and (Pre-) Teacher Training Schedule can always be found on the Website. Delight Yoga reserves the right to change the schedule at any time. If applicable, any changes are announced in advance by putting up posters in the Delight Yoga studios, mentioning them on the Website or by email.
2. Delight Yoga reserves the right to cancel a scheduled Workshop, (Pre-) Teacher Training in the event of force majeure (including illness of the relevant teacher). In this case, the registration fee already paid is refunded.
21. Health
1. The Pre Teacher Training, the Teacher Training or the APS have an intensive schedule and curriculum that is physically, mentally, and emotionally demanding. By participating, the Participant declares that he/she is healthy on a medical and mental-health level and is ready to fully participate in the demands of the program of the Pre Teacher Training, the Teacher Training or the APS, as the case may be. Additionally, the Participant must be able to support the group learning process. The Participant may be requested to leave the Pre Teacher Training, the Teacher Training or the APS, as the case may be, if it is determined by the Teachers that his/her participation would in any way compromise a safe and cohesive learning environment.
2. By participating in the Pre Teacher Training, the Teacher Training or APS, as the case may be, the Participant declares that he/she is aware that it is his/her own responsibility to take care of his/her own health and well-being during such training at all times.
3. In addition to the stipulations of article 20.1, Delight Yoga reserves the right to require clinical evaluations or other information to competently evaluate the Participant’s medical and/or mental-health preparedness.
22. Liability
1. Delight Yoga shall not be liable for any injury, loss or damages in connection with, or resulting from, participation in the Pre Teacher Training or the Teacher Training, as the case may be.
2. The Participant will never engage Delight Yoga, the Teachers, or any of the supporting staff, in legal proceedings relating to possible damages in whatever form, that may be the result of participation in the Pre Teacher Training or the Teacher Training, as the case may be.
3. Delight Yoga only works with qualified yoga teachers and will always offer yoga classes of the highest quality. Nonetheless, there is always a risk of injury involved when taking a yoga class. By participating in the Pre Teacher Training or the Teacher Training, as the case may be, the Participant accepts such risk of injury. Delight Yoga offers the following guidelines to diminish the risk of injury:
– Consult with a physician when you are not sure you are completely healthy, or if you are pregnant, before starting to take yoga classes.
– If you have an injury, or other physical issue, inform the yoga teacher thereof before you start your yoga class.
– Listen to and follow the instructions of the yoga teacher.
– Be conservative when exercising yoga and listen to your physical limitations.
– Don’t do any exercises that are painful.
– Ask questions when you do not understand an exercise.
23. Applicable law, dispute resolution
1. Dutch law applies exclusively to the General Terms and Conditions.
2. Any disputes in connection with the General Terms and Conditions, or the participation in a Workshop, Retreat or Pre Teacher Training or the Teacher Training, as the case may be, will be resolved exclusively by a certified mediator in Amsterdam (Netherlands).
24. Complaints Procedure Delight Academy | Ayurveda (Amsterdam, July 2017)
1. The Delight Academy assumes that all employees involved in the academy will do everything possible to serve in the best interests of the Students. However if a situation occurs that does not meet the Students expectations and there is a complaint regarding the Academy, please follow the following procedure:
2. Contact the person whom the complaint concerns. This can either be the teacher or any other employee of the Academy. We strive to work out all complaints this way. Remember: a good Teacher-Student relationship is important to Delight Academy, therefore we are open to solve any inconveniences experienced by the Students.
3. If you are not able to solve your problem with the person whom the complaint concerns, as described above, then please send your written complaint to the complaint coordinator mentioning your name, address, telephone number, email-address, study-year, current date and a clear description of your complaint. If you have any written correspondence, please add this to your letter. The clearer and more complete your complaint, the easier it is for us to judge your complaint.
4. Send your complaint to: Delight Academy Ayurveda, Attn. complaint coordinator, Prinseneiland 20G, 1013 LR Amsterdam
5. Within 10 days of acceptance of the complaint, the Student shall receive a letter in which the complaint procedure is described.
6. Within three weeks the Student shall receive a written reaction on their complaint. We strive for this, however if the complaint is too complex, it may take longer, in which case the Student will be informed.
7. Possibility for appeal: Delight Academy will do everything they can to solve your complaint. However there is a possibility that the Student does not agree with the answer. In which case, the Student has the possibility to submit the complaint to a third independent party. The academy is for the handling of complaints connected to the FONG. The ruling of the FONG is binding.
8. All complaints are confidential. The complaint will be kept in file for two years.
25. Copyright Clause Delight Academy
1.The provided material has been accumulated with the utmost care. All materials, including images, text, presentations, etc. that are provided during the APS program are protected by Copyright and may not be used or copied without permission of Delight Academy.
2. Students of the APS become the owner of the study material. They can use it to study and the Student is not allowed to sell the study material under a different name or brand.
