Article 1. General | Concepts

Article 1.1 | Content

1. This Student Statute regulates the legal position of those who fall under the scope of this statute as described in Article 1.2.
2. The rights and obligations associated with the legal position as referred to in the first paragraph are also determined by:
   1. 1. The law and resulting regulations;
      2. The decisions taken jointly by the Management and Board of Delight Academy B.V.;

• What is determined in this Statute, the Education and Examination Regulations (OER) and the Complaints Procedure of Delight Academy B.V.

Article 1.2 | Scope

This Student Statute applies to Students who participate in the HBO-compliant training for “Ayurveda Practitioner” (“APS”) at the Delight Academy B.V. with Chamber of Commerce number 67336965 (“Delight Academy”)

Article 1.3 | Definitions

In this Student Statute the following terms have the following meanings:

Article 2 | Participation

Article 2.1 | Entry Requirements

1. The minimum age to be admitted to the APS is 18 years. Exceptions are possible after consultation with the Examination Board and the Directors.
2. The program offered within the APS is at HBO-Bachelor level. For admission to the APS, the Student must meet the following conditions:
   1. At least completed HAVO education or to have a comparable level of thinking and working (for International Students: HAVO equivalent education)
   2. Command of the English language, spoken and written
   3. Before the APS starts, watch the film Ayurveda Unveiled (available for purchase)
   4. Having attended an open day of Delight Academy. If attending an open day is not possible for you, please contact us via [email protected].

Article 2.2 | Registration

1. Registration for the APS takes place after receipt of the fully completed registration form from the website.
2. When registering for the APS, the Students are expected to take the following steps:
   1. Fill in the registration form and related questions;
   2. Upload a motivation letter, profile photo and HAVO or higher level education diploma;
   3. Agree to Delight Academy’s Student Statute and Terms of Conditions;
   4. Pay the Application Fee.
3. After registration, the Student will receive an invitation for an intake meeting within 10 working days. If the outcome is positive, the Student will receive an email with information about the APS, curriculum and payment options for the annual Education Fee as described in Article 2.3.
4. The Academy reserves the right to deny admission to any applicant.
5. Application forms are handled in order of receipt. Registration takes place according to the date of completion of the registration procedure. If there is a waiting list, the Student will be notified by email when registering. If a place becomes available, the relevant Student will be contacted.

Article 2.3 | Payment Education Fee & Cancellation

1. Upon registration, the Student must pay an Application Fee as stated on the application form. The Application Fee is non-refundable.
2. After admission to the APS, the Student will receive an email from Delight Academy with the payment options for the Education Fee.
3. Participation in the APS is only possible after payment of the annual Education Fee prior to the start of the academic year, or during the academic year if paying in installments.
4. In case of an "Early Bird" Fee, the entire amount must be transferred in one payment before April 15 prior to the start of the first academic year.
5. In case of a “Standard Fee” or “Payment in installments”, a deposit has to be made to confirm your registration.
6. The Education Fee (in full or the first installment) must be paid before August 1. In the case of installments, the second installment must be paid before December 1 and the third installment before March 1.
7. During the cooling-off period of two weeks it is possible to cancel the registration. The deposit or Early Bird Fee will be refunded within 14 days. After the cooling-off period, the deposit will become non-refundable.
8. If participation is canceled up to two months (July 1) before the start of the academic year (September 1), the Education Fee, excluding €350, will be reimbursed.
9. If participation is canceled within two months before the start of the academic year (September 1), the Education Fee will be reimbursed minus €750 for costs incurred for preparation of the study track for the respective student.
10. For Years 2 to 4, students will be automatically enrolled in the following year after successful completion of the previous study year. The Education Fee (in full or first installment) must be paid before August 1. If the student does not comply with this, the study program cannot be continued.
11. Delight Academy reserves the right not to start the Ayurveda Practitioner Studies if there are insufficient participants in the first, second, third and fourth year. In such a case, the paid Education Fee will be refunded within 14 days.
12. The minimum number of participants for the first academic year has been set at 25. Second, third and fourth academic years will only start with at least 15 participants.
13. Participants will be informed at least one month (August 1) before the start of the academic year in case the program will not start.
14. If the Student stops the program after it has started, the Education Fee will not be refunded. If the Student pays in installments, the remaining installments must still be paid.
15. Cancellation of participation in the APS can only take place in writing. In that case, an email should be sent to: [email protected]
16. The Education Fee is exempt from Dutch VAT on the basis of the CRKBO exemption granted to Delight Academy.
17. Delight Academy reserves the right to adjust the prices of the program annually. Price changes are communicated to the Students by email at least three months before the academic year starts. Current prices are listed on the payment page of the APS website.
18. In case of unforeseen circumstances in which the government imposes regulations or when it is deemed better, Delight Academy reserves the right to postpone, cancel or continue the Ayurveda Practitioner Studies online. In this case, Delight Academy is not liable for a refund of any deposit made prior to cancellation or postponement of the Ayurveda Practitioner Studies.

Article 2.4 | Additional Costs to the Study Program

The following additional costs will apply to the APS program (only where applicable for the Student):

Article 2.5 | Health

The APS contains an intensive curriculum that can be demanding on a physical, mental and emotional level. Upon registration with the APS, the Student confirms that s/he is in a balanced medical and mental health. The Student must also have a positive impact on the study environment of the group. In exceptional circumstances, the Student may be requested to leave the APS, if it has been determined by the Academy and the Teachers that his/her participation in the Studies negatively affects his/her health or the class environment.

Article 3 | Program

Article 3.1 | Language

The language of instruction of the APS is English. Excellent written and spoken command of the English language is therefore one of the requirements for admission to the APS. Dutch Students are allowed to hand in their assignments in Dutch only when the respective teacher is also Dutch-speaking. Important Academy documents are made available in both English and Dutch.

Article 3.2 | Quality Assurance

The education that is offered within the APS is at HBO level. The quality of the APS is under the control of the SNRO when the accreditation is granted.

Article 3.3 | Study Counseling

During the APS, every Student is supervised by a Student Mentor and the Teachers in order to promote the study and development progress. The Student counseling system is comprised of the following components:

1. The online Learning Management System (LMS) gives Students and Teachers the opportunity to view and monitor tests, homework assignments, reports, practical tests and study results. This system also provides access to the required teaching materials per APS module.
2. Twice a year the Students are invited for an individual meeting with the Student Mentor. During the meeting, the learning progress is reviewed and the Students get the opportunity to share their experience and set personal development goals.
3. If more guidance is needed, the student can request this through the Student Mentor or by contacting Delight Academy at [email protected]. Extra costs will apply (article 2.4).

Article 3.4 | Certification & Diploma Presentation

1. The APS is a 4-year part-time study. Each year consists of an average of 200 contact hours and 1100 self-study hours. Students are one average expected to attend 2-3 days of classes and dedicate 12-15 days of self-study on a monthly basis.
2. To obtain a Certificate or Diploma, the attendance requirement (Article 3.5) and the education and examination regulations apply. At the end of the APS, the Academy awards the Bachelor Ayurveda Practitioner Diploma to all Students who have fulfilled the study requirements. Official APS Certificates for completion of all other study years are available digitally at the end of the respective academic year.
3. For Students who take the re-exam and/or have not yet completed their assignments, the Certificate will be issued in September. Students who do not yet meet the requirements for a Certificate by September 1, will receive it in July of the following year, provided they have fulfilled the study requirements on class attendance and assignments. Students who fail to meet these requirements will not be allowed to proceed into the following year.

Article 3.5 | Attendance Requirements

1. An attendance requirement of 75% of the lessons (contact hours) per year applies for Students. If for any reason it is not possible for a Student to participate in a class, they are obliged to inform the Student Support Coordinator and Teacher as soon as possible. The Students are responsible for finding a suitable solution together with the Teacher to make up for the missed lessons. In principle it is not possible to catch up. Online classes/webinars do not make an exception from this rule and students are therefore expected to also be present for these. In exceptional cases, links of class recordings (where applicable) are made available to the Students by the Delight Academy for 10 days after a class.
2. The massage module is a mandatory curriculum component in order for a Student to move on to the next year. In case more than one day of this block is missed, Students need to catch up during the set dates provided by Delight Academy. The catch-up modules consist of two practical days and extra costs apply ( article 2.4).
3. The yearly residential module is another mandatory part of the APS. The costs for accommodation and food are not included in the yearly tuition fee and are thus at the Student’s expense. The amount for room and board, and the cancellation policy will be communicated during the respective Academic Year and need to be paid prior to the start of the residential (see article 2.4).
4. The internship is another crucial part of the curriculum and needs to be completed in order to successfully complete the APS. Additional costs apply (article 2.4).
5. The attendance of the Students is monitored by Delight Academy. In exceptional cases where a Student has a serious personal reason for not attending part of the APS, a plan will be discussed on a case-by-case basis.
6. In the event of premature termination or long-term interruption (longer than one study year) of the APS by the Students, no claim can be made for replacement lessons. The relevant APS Year must be repeated. The financial consequences have to be paid by the Students unless otherwise stated.
7. In exceptional situations, and only with the permission of the Directors, Students are permitted to postpone their study for a maximum of one year and continue in another group. A transfer can be requested via a written motivation. Extra administration costs apply, plus the difference in Education fee. (article 2.4)

Article 3.6 | Teaching Materials

1. At the start and during the Academic Year, the Student receives Delight Academy readers, manuals and study books (extra amount in addition to the Annual Education Fee). The purchase of study books is at the expense of the Student.
2. At the start of the study, the Student will receive a login for the Online Learning Management System (LMS), which is the main online learning platform for the APS. In case of discontinuation or successful graduation from the study, the LMS account will be retained for one year, after which it will be deleted.
3. At the beginning of each Academic Year, the Students receive an annual class schedule, which includes all teaching days, assignment deadlines, examinations and locations. The same class schedule is available for the Students in the LMS. Delight Academy reserves the right to adjust the curriculum, class schedule and class locations throughout the Academic Year, if circumstances require adaptations.

Article 4 | Ownership and Copyright of the Teaching Material

The issued and printed APS teaching materials are the property of the Student and have been explicitly developed for personal use. The content may not be duplicated and/or distributed without the permission of the author. The copyright of the teaching material rests with Delight Academy and the Teachers who compiled it.

It is forbidden to make audio and video recordings during lessons and to record or use the online lesson material for other purposes.

Article 5 | Locations

1. Delight Academy classes are mainly located at the following two locations: Prinseneiland 20G in Amsterdam (Delight Yoga Studio) and Achtergracht 16A in Weesp (Yoga Today Studio)
2. All locations used by Delight Academy and equipment made available during the lessons must be treated with respect. Any damage must be reported immediately to the Student Support Coordinator. In the event of negligence, the costs arising from the damage will be charged to the person who caused it.
3. Delight Academy reserves the right to change the location of classes and adjust these accordingly in order to better fit the purposes of the studies or in case circumstances so require.

Article 6 | Liability

1. Attending classes at the various locations and leaving belongings in the locker room is the Student's personal responsibility and liability. Delight Academy is not liable for damage to personal belongings of Students attending classes.
2. If a Student unexpectedly causes damage to a fellow Student, the Student in question will be held liable. The Student is considered to have personal liability insurance.
3. Delight Academy is not liable for personal injury sustained during the lessons. Participation in classes is always the responsibility of the Student.
4. The Student must always follow the instructions of the teacher during the lessons when it comes to guaranteeing safety.
5. The Student is personally responsible for consulting a doctor if there are any health problems or pregnancy before attending classes. If it is not entirely clear to the Student whether participation is possible for specific lessons, such as massage, this will be discussed in advance with the teacher on the Student's initiative.
6. If the Student starts giving consultations and treatments during the training, he/she must take out liability insurance with Balens (for this refer to the "Rules for Safe Practice" document in the LMS).
7. Although we strive to provide Students with all relevant information in advance via the LMS, the website and the study material, no rights can be derived from this and we are not liable for any errors therein.

Article 7 | Complaints Procedure

Delight Academy assumes that all employees involved in the academy will do everything possible to serve in the best interests of the students. However, if a situation occurs that does not the students expectations and there is a complaint regarding Delight Academy, please follow the following procedure:

1. Contact the person whom the complaint concerns. This can either be the teacher or any other employee of Delight Academy. We strive to work out all complaints this way. Remember: a good teacher-student relationship is important to Delight Academy, therefore we are open to solve any inconveniences experienced by the students.
2. If you are not able to solve your problem with the person whom the complaint concerns, as described above, then please send your written complaint to the complaint coordinator mentioning your name, address, telephone number, email-address, study-year, current date and a clear description of your complaint. If you have any written correspondence, please add this to your letter. The clearer and more complete your complaint, the easier it is for us to judge your complaint.
3. Send your complaint to: Delight Academy Ayurveda, Attn. complaint coordinator, Prinseneiland 20G, 1013 LR Amsterdam
4. Within 10 days of acceptance of the complaint, the Student shall receive a letter in which the complaint procedure is described.
5. Within three weeks the Student shall receive a written reaction on their complaint. We strive for this, however if the complaint is too complex, it may take longer, in which case the Student will be informed.
6. Possibility for appeal: Delight Academy will do everything they can to solve your complaint. However there is a possibility that the Student does not agree with the answer. In which case, the Student has the possibility to submit the complaint to a third independent party: the FONG. The ruling of the FONG is binding.
7. All complaints are confidential. The complaint will be kept in file for two years.

Article 8 | Privacy Regulation

Delight Academy is bound by the GDPR, General Data Protection Regulation.

Personal data of the Students and those involved will therefore be treated in strict confidence and will only be used for administrative purposes. The basic administration includes:

1. Name
2. Address details
3. Place of residence
4. Phone number
5. Email
6. Date of birth
7. Relevant Preparatory Education
8. Any health complaints / medicines that should be taken into account

Data from the basic administration will not be provided to third parties, unless the Student has given written permission to do so.

Article 10 | Final Provisions

This Student Statute is valid from: 21 April 2022

In case this Statute or the law does not provide, the Board of Delight Academy will decide.

Delight Academy reserves the right to unilaterally change these general terms and conditions. The amended conditions will be sent to the Student. If the Student is a natural person, not acting in the exercise of a profession or business, and the new conditions bring about a substantial change, the Student is entitled to terminate the agreement prematurely.

Artikel 1. Algemeen | Begrippen

Artikel 1.1 | Inhoud

1. Dit Studentenstatuut regelt de rechtspositie van degenen die vallen onder de reikwijdte van dit statuut zoals beschreven in artikel 1.2.
2. De rechten en plichten die behoren bij de rechtspositie als bedoeld in het eerste lid worden mede bepaald door:

1. De wet en daaruit voortvloeiende regelgeving;
2. De besluiten die gezamenlijk zijn genomen door het Management en Bestuur van Delight Academy B.V.;
3. Hetgeen is bepaald in dit Statuut, het Onderwijs- en Examenreglement (OER) en de Klachtenregeling van Delight Academy B.V..

Artikel 1.2 | Reikwijdte

Dit studentenstatuut is van toepassing op Studenten die deelnemen aan de HBO-conforme opleiding tot “Ayurveda Practitioner’ (“APS”) aan de Delight Academy B.V. met kvk nummer 67336965 (“Delight Academy”)

Artikel 1.3 | Definities

In dit Studentenstatuut wordt verstaan onder:

Artikel 2 | Deelname

Artikel 2.1 | Toelatingseisen

1. De minimumleeftijd om tot de APS te worden toegelaten te worden is 18 jaar. Uitzonderingen zijn mogelijk na overleg met de Examencommissie en de Directors.
2. Het programma dat binnen de APS wordt aangeboden is op HBO-Bachelor niveau. Voor toelating tot de APS dient de student aan de volgende voorwaarden te voldoen:

1. Minimaal afgeronde Havo-opleiding of een vergelijkbaar denk- en werkniveau (voor internationale studenten geldt: HAVO-equivalent onderwijs).
2. Beheersing van de Engelse taal in woord en geschrift
3. Voor de start van de APS de film ‘Ayurveda Unveiled’ kijken. (beschikbaar bij Delight Academy)
4. Een open dag van de APS bij Delight Academy bijwonen. (wanneer dit niet mogelijk is, neem dan contact op via [email protected])

Artikel 2.2 | Inschrijving

1. Inschrijving voor de APS vindt plaats na ontvangst van het volledig ingevulde aanmeldingsformulier op de website.
2. De Studenten worden bij inschrijving voor de APS geacht de volgende stappen te ondernemen:

1. Invullen van het aanmeldingsformulier en bijbehorende vragen;
2. Uploaden van een motivatiebrief, profielfoto en diploma van een afgeronde opleiding met minimaal HAVO niveau;
3. Goedkeuring van de studentenstatuut van Delight Academy en de Terms and Conditions;
4. Voldoen van een online betaling.

3. Na inschrijving krijgt de student binnen 10 werkdagen een uitnodiging voor een intake. Bij een positief advies ontvangt de student een e-mail met informatie over het curriculum en de betaalopties voor het voldoen van de jaarlijkse Onderwijs Fee zoals beschreven in artikel 2.3.
4. The Academy behoudt zich het recht voor om studenten te weigeren voor welke reden dan ook.
5. Aanmeldingsformulieren worden op volgorde van binnenkomst behandeld. Inschrijving vindt plaats naar datum afronding aanmeldprocedure. Indien er een wachtlijst bestaat ontvangt de student hierover bij aanmelding bericht per e-mail. Indien een plek beschikbaar komt wordt de betreffende Student op de hoogte gesteld.

Artikel 2.3 | Betaling Onderwijs Fee & Annulering

1. Bij inschrijving dient de Student een betaling te doen van het inschrijfgeld zoals vermeld staat op het aanmeldingsformulier. Het inschrijfgeld wordt niet gerestitueerd.
2. Na toelating tot de APS ontvangt de Student een e-mail van Delight Academy met de betaalopties voor de Onderwijs Fee.
3. Deelname aan de APS is slechts mogelijk na betaling van de Onderwijs Fee of een betaling verspreid in termijnen gedurende het studiejaar.
4. In geval van een ‘Early Bird’ Fee dient het gehele bedrag in één keer overgemaakt te worden vóór 15 april voorafgaande aan het eerste studiejaar.
5. In geval van “Standaard Fee” of betaling in termijnen, dient een voorschot te worden betaald om de registratie te bevestigen.
6. De Onderwijs Fee (in zijn geheel of de eerste termijn) dient vóór 1 augustus betaald te worden. In geval van termijnbetalingen dienen de tweede termijn vóór 1 december en de derde termijn vóór 1 maart te worden voldaan.
7. Tijdens de afkoelingsperiode van twee weken is het mogelijk om de inschrijving ongedaan te maken en wordt het voorschot Onderwijs Fee of Early Bird Fee binnen 14 dagen teruggestort. Het inschrijfgeld wordt niet gerestitueerd. Na de afkoelingsperiode wordt het voorschot niet gerestitueerd.
8. Indien er annulering van deelname plaatsvindt tot twee maanden (1 juli) voor aanvang van het studiejaar (1 september), vindt er terugbetaling plaats van de Onderwijs Fee met aftrek van €350.
9. Indien er annulering van deelname plaatsvindt binnen twee maanden voor aanvang van het studiejaar (1 september) vindt er terugbetaling plaats van de Onderwijs Fee met aftrek van €750 voor gemaakte kosten in verband met de voorbereiding van het programma.
10. In het geval van jaar 2 tot en met 4 geldt dat na succesvol afronden van het voorgaande studiejaar, de student automatisch wordt aangemeld voor het volgende schooljaar. De Onderwijs fee (in zijn geheel of het eerste termijn) dient vóór 1 augustus betaald te worden. Wanneer de student hieraan niet voldoet, kan er niet gecontinueerd worden met het opleidingsprogramma.
11. Delight Academy behoudt zich het recht voor om de Ayurveda Practitioner Studies niet te laten starten bij onvoldoende deelnemers in zowel het eerste, tweede, derde en vierde jaar. In een dergelijk geval wordt de betaalde Onderwijs Fee binnen twee weken teruggestort.
12. Het minimale aantal deelnemers voor het eerste studiejaar is gesteld op vijfentwintig. Voor het tweede, derde en vierde studiejaar geldt dat deze enkel zullen starten bij minimaal vijftien deelnemers.
13. Deelnemers zullen minimaal een maand voor aanvang van het studiejaar (1 augustus) worden geïnformeerd indien het programma niet zal starten.
14. Indien de student na aanvang tussentijds stopt met het programma, vindt er geen restitutie van de Onderwijs Fee plaats. Indien de student betaalt in termijnen, dienen de resterende termijnen alsnog te worden voldaan.
15. Het annuleren van deelname aan de APS kan enkel schriftelijke plaatsvinden. Er dient in dat geval een mail gestuurd te worden aan: [email protected].
16. De Onderwijs Fee is vrijgesteld van Nederlandse BTW op grond van de aan Delight Academy toegekende CRKBO-vrijstelling.
17. Delight Academy behoudt zich het recht voor om de prijzen van het programma jaarlijks aan te passen. Prijswijzigingen worden via een mail minimaal drie maanden voordat het studiejaar begint bekend gemaakt aan de studenten. De huidige prijzen worden vermeld op de betalingspagina van de website.
18. In geval van onvoorziene omstandigheden waarin de overheid maatregelen oplegt of wanneer het redelijkerwijs beter is, behoudt Delight Academy zich het recht voor om de Ayurveda Practitioner Studies uit te stellen, te annuleren of online voort te zetten. In dit geval is Delight Academy niet aansprakelijk voor restitutie van enige aanbetaling die is gedaan voorafgaand aan annulering of uitstel van de Ayurveda Practitioner Studies.

Artikel 2.4 | Additionele kosten

De volgende additionele kosten kunnen van toepassing zijn op het APS programma (alleen indien van toepassing voor de student):

Artikel 2.5 | Gezondheid

De APS bevat een intensief curriculum dat op fysiek, mentaal en emotioneel niveau veeleisend kan zijn. Bij inschrijving tot de APS bevestigt de Student dat hij/zij in goede medische en geestelijke gezondheid verkeert. De Student dient ook het ontwikkelingsproces van de groep te kunnen bevorderen. In uitzonderlijke situaties kan de Student na overleg worden verzocht om de APS te verlaten indien is vastgesteld door de Academy en de Docenten dat de voortgang van zijn/haar deelname ten koste gaat van zijn/haar gezondheid en geen veilige omgeving kan worden gegarandeerd.

Artikel 3 | Programma

Artikel 3.1 | Taal

De voertaal binnen de APS is Engels. Goede beheersing van de Engelse taal in woord en geschrift is derhalve een van de vereisten voor toelating tot de APS. Wanneer de betreffende docent Nederlandse spreekt, mogen Nederlands sprekende Studenten hun huiswerkopdrachten in het Nederlands inleveren. Belangrijke documenten van de Academy worden zowel in het Engels als in het Nederlands beschikbaar gesteld.

Artikel 3.2 | Kwaliteitswaarborging

Het onderwijs dat binnen de APS wordt aangeboden is op Hbo-niveau. De kwaliteit van de APS staat onder controle van het SNRO op het moment dat de accreditatie is toegekend.

Artikel 3.3 | Studiebegeleiding

1. Tijdens de APS wordt iedere student begeleid door de Studenten Mentor en de Docenten ter bevordering van het studie-en ontwikkelingsproces. Het systeem van studiebegeleiding omvat de volgende onderdelen:

1. Het online LMS geeft Studenten en Docenten de mogelijkheid om toetsen ter afsluiting van een APS-module, in te leveren huiswerkopdrachten, verslagen, praktijktoetsen en studieresultaten in te zien en te monitoren. Dit systeem geeft tevens toegang tot het benodigde lesmateriaal per APS-module.
2. Twee keer per jaar wordt de Student uitgenodigd voor een individueel gesprek met de Mentor. Tijdens deze meeting wordt de voortgang van het studietraject besproken, en de Student wordt uitgenodigd om zijn/haar ervaring te delen en doelen ter bevordering van de persoonlijke ontwikkeling te stellen.
3. Wanneer meer persoonlijke begeleiding gewenst is kan de Student hiervoor een verzoek indienen via de Mentor of contact opnemen met Delight Academy via [email protected] Extra kosten worden hiervoor in rekening gebracht (artikel 2.4).

Artikel 3.4 | Certificering & Diploma uitreiking

1. De APS is een 4-jarige deeltijdopleiding. Elk jaar bestaat gemiddeld uit 200 contacturen en 1100 zelfstudie-uren. De Student wordt gemiddeld op maandelijkse basis verwacht om 2-3 lesdagen bij te wonen en 12-15 dagen aan zelfstudie te doen. 
2. Om een Certificaat of Diploma te verkrijgen geldt de aanwezigheidsplicht (artikel 3.5) en de regels conform het onderwijs- en examenreglement. Aan het einde van de APS reikt de Academy een Bachelor Ayurveda Practitioner Diploma uit aan studenten die hebben voldaan aan alle eisen. APS certificaten voor het voldoen van andere studiejaren zijn digitaal beschikbaar aan het einde van het betreffende studiejaar in juli.
3. Voor studenten die deelnemen aan het herexamen en/of studenten die hun huiswerkopdrachten nog niet volledig hebben ingediend, wordt het certificaat in September uitgereikt. Studenten die per 1 September nog niet voldoen aan de eisen voor een certificaat, zullen deze in juli van het volgende jaar ontvangen, mits zij voldoen aan alle gestelde eisen met betrekking tot aanwezigheid, huiswerkopdrachten en studie eisen. Studenten die niet aan alle eisen voldoen, worden niet toegelaten in het volgende studiejaar.

Artikel 3.5 | Aanwezigheidsplicht 

1. Voor de Student binnen de APS geldt een aanwezigheidsplicht van 75% van de lessen (contacturen) per jaar. Indien het om enige reden niet mogelijk is voor de Student om deel te nemen aan een onderdeel van de APS, is hij/zij verplicht de Student Support Coördinator en de Docent zo spoedig mogelijk te informeren. De Student draagt de verantwoordelijkheid om samen met de Docent een passende oplossing te vinden om de gemiste lessen in te halen. In principe is het niet mogelijk om lessen in te halen. Online lessen/Webinars zijn onderdeel van de aanwezigheidsplicht. De Student wordt verwacht om aanwezig te zijn op de aangegeven data. In uitzonderlijke gevallen worden links naar de opnamen (indien van toepassing) beschikbaar gemaakt door Delight Academy voor 10 dagen.
2. De massage module is een verplicht onderdeel van de APS om door te kunnen gaan naar het volgende studiejaar. Wanneer meer dan één dag wordt gemist dient de student de module in te halen op de door de Academy aangegeven data. De ‘catch-up’ bestaat uit twee praktijkdagen en extra kosten zijn van toepassing (artikel 2.4)
3. De jaarlijkse residential module is een verplicht onderdeel van de APS. De kosten voor eten en accommodatie zijn niet inbegrepen in de jaarlijkse Educatie Fee en zijn voor kosten van de Student. Het bedrag voor de accomodatie en eten, en de annuleringsvoorwaarden worden tijdens het betreffende jaar gecommuniceerd en moeten voorafgaand aan de residential worden voldaan (artikel 2.4)
4. De stage is een cruciaal onderdeel van de APS en moet voldaan zijn om succesvol de de APS af te ronden. Extra kosten zijn van toepassing (artikel 2.4)
5. De aanwezigheid van de Student wordt bijgehouden door Delight Academy. In uitzonderlijke gevallen, indien er een persoonlijke reden is waarom de Student niet kan deelnemen is er ruimte om dit te bespreken op individueel niveau. 
6. Bij tussentijdse beëindiging of langdurige onderbreking (langer dan één jaar) van de APS door de Student kan er geen aanspraak op vervangende lessen worden gemaakt. Het betreffende APS jaar dient dan opnieuw te worden gevolgd. De financiële gevolgen hiervan zullen door de Student te moeten worden voldaan tenzij anders besproken.
7. In uitzonderlijke gevallen en alleen met toestemming van de Directors, is het de Student toegestaan om zijn/haar studie te pauzeren voor maximaal één jaar en door te gaan in een andere groep. Een schriftelijk verzoek met motivatie kan worden ingediend. Extra kosten zijn van toepassing, plus het verschil in fee (artikel 2.4)

Artikel 3.6 | Lesmateriaal

1. De Student ontvangt bij aanvang en gedurende het studiejaar Delight Academy readers, manuals en Delight Academy studieboeken (extra bedrag naast de Jaarlijkse Educatie Fee). De aanschaf van deze boeken is voor rekening van de Student.
2. Bij aanvang van de studie ontvangt de student een login voor het Online Leersysteem (LMS), dat wordt gebruikt als algemeen leerplatform voor de APS. Bij stopzetting of succesvolle afronding van de studie wordt je LMS-account één jaar bewaard. Daarna wordt het gedeactiveerd.
3. De Studenten ontvangen aan het begin van elk studiejaar een jaarplanning met lesdagen, deadlines voor huiswerkopdrachten en toetsmomenten. Eveneens wordt de jaarplanning beschikbaar gemaakt in LMS. Delight Academy behoudt zich het recht voor om de jaarplanning en curriculum en/of locatie te wijzigen gedurende het studiejaar, indien de situatie dit vereist.

Artikel 4 | Eigendomsrecht en copyright van het lesmateriaal

Het uitgereikte en geprinte APS-lesmateriaal is eigendom van de Student en is uitdrukkelijk ontwikkeld voor eigen gebruik. De inhoud mag niet zonder toestemming van de auteur gedupliceerd en/of verspreid worden. Het copyright van het lesmateriaal berust bij Delight Academy en de docenten die dit hebben samengesteld.

Het is verboden geluids- en beeldopnames te maken gedurende lessen en het online lesmateriaal op te nemen of voor andere doeleinden te gebruiken.

Artikel 5 | Locaties

1. De lessen van Delight Academy zijn hoofdzakelijk op twee locaties: Prinseneiland 20G in Amsterdam - in 1 van de studio’s van Delight Yoga en Achtergracht 16A in Weesp (Yoga Today).
2. Alle door Delight Academy gebruikte locaties en ter beschikking gestelde spullen tijdens de lessen dienen met respect behandeld te worden. Eventuele schade dient direct bij de Student Support Coördinator gemeld te worden. Bij nalatigheid worden de uit de schade voortvloeiende kosten in rekening gebracht bij degene die ze heeft veroorzaakt.
3. Delight Academy behoudt zich het recht voor om de locatie te wijzigen gedurende het studiejaar indien dit beter past bij het programma of indien noodzakelijk.

Artikel 6 | Aansprakelijkheid

1. Het bijwonen van lessen op de verschillende locaties en het achterlaten van bezittingen in de kleedkamer valt onder de persoonlijke verantwoordelijkheid en aansprakelijkheid van de student. Delight Academy is niet aansprakelijk voor schade aan persoonlijke bezittingen van studenten die lessen bijwonen.
2. Wanneer een student onverhoopt schade aanricht bij een medestudent, wordt de betreffende student aansprakelijk gesteld. De student wordt geacht een persoonlijke aansprakelijkheidsverzekering te hebben.
3. Delight Academy is niet aansprakelijk voor persoonlijk letsel dat wordt opgelopen tijdens de lessen. Het deelnemen aan lessen is altijd de verantwoordelijkheid van de student.
4. De student dient tijdens de lessen altijd de instructies van de docent op te volgen daar waar het gaat om het borgen van de veiligheid.
5. De student is persoonlijk verantwoordelijk voor het raadplegen van een arts indien er sprake is van gezondheidsproblemen of zwangerschap alvorens lessen bij te wonen. Indien het voor de student niet geheel duidelijk is of deelname mogelijk is voor specifieke lessen, zoals massage, dan wordt dit op initiatief van de student vooraf met de docent besproken.
6. Indien de student tijdens de opleiding start met het geven van consulten en behandelingen, dient hij/zij een aansprakelijkheidsverzekering af te sluiten bij Balens (zie hiervoor het  document ‘Rules for Safe Practice’ in het LMS).
7. Hoewel wij ernaar streven om studenten vooraf alle relevante informatie te geven via het LMS, de website en het studiemateriaal, kunnen hier geen rechten aan ontleend worden en zijn wij niet aansprakelijk voor eventuele fouten hierin.

Artikel 7 | Klachtenregeling

Verwezen wordt naar de klachtenregeling (complaint procedure) op onze website.

Artikel 8 | Privacy regeling

Delight Academy is gehouden aan de AVG, Algemene Verordening Gegevensbescherming.

Persoonsgegevens van de Studenten en betrokkenen zullen derhalve strikt vertrouwelijk worden behandeld en alleen gebruikt worden voor administratieve doeleinden. In de basisadministratie zijn opgenomen:

• Naam
• Adresgegevens
• Woonplaats
• Telefoonnummer
• E-mail
• Geboortedatum
• Relevante Vooropleidingen
• Eventuele gezondheidsklachten/medicijnen waarmee rekening gehouden dient te worden

Gegevens uit de basisadministratie worden niet aan derden verstrekt, tenzij de Student hiertoe schriftelijke toestemming heeft gegeven.

Artikel 9 | Onderwijs-en Examenreglement

Artikel 10 | Slotbepalingen

Dit studentenstatuut is geldig met ingang van: 21 april 2022

In geval dit Statuut of de wet niet voorziet beslist het Bestuur van Delight Academy. 

Delight Academy behoudt zich het recht voor deze algemene voorwaarden eenzijdig te wijzigen. De gewijzigde voorwaarden zullen aan de student worden toegezonden. Als de student een natuurlijk persoon is, niet handelend in de uitoefening van een beroep of bedrijf, en de nieuwe voorwaarden een wezenlijke verandering teweegbrengen, is de student gerechtigd de overeenkomst tussentijds te beëindigen.
